Rules governing your use of the SyncSocial platform and services.

1. Acceptance of Terms

These Terms of Service are an agreement between you and SyncSocial (ABN 25 643 590 265), an Australian business ("SyncSocial", "we", "us"). By accessing or using SyncSocial (the "Service"), you accept and agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

SyncSocial provides AI-powered social media management tools including content creation, scheduling, multi-platform publishing, analytics, and related services. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Distribute spam, malware, or harmful content
  • Engage in any automated use of the system without our express written permission
  • Attempt to gain unauthorized access to any portion of the Service
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers

5. Content Ownership and Rights

You retain ownership of all content you create, upload, or post through the Service. By using the Service, you grant SyncSocial a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to all content you submit.

6. Third-Party Platforms

The Service allows you to connect and publish content to third-party social media platforms. You acknowledge that your use of these platforms is subject to their respective terms of service and privacy policies. SyncSocial is not responsible for the actions, policies, or content of third-party platforms.

7. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees for your chosen subscription plan
  • Provide accurate and complete billing information
  • Authorize us to charge your payment method on a recurring basis
  • Accept that subscriptions automatically renew unless cancelled

SyncSocial is sold as a single subscription of A$199 per month plus GST, billed monthly in advance in Australian dollars (AUD) to one business workspace. Subscriptions automatically renew each month using your saved payment method, at the then-current rate, until cancelled. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current paid month and you retain access until that date. GST is calculated and shown at checkout. New customers may be offered a 7-day free trial; unless you cancel before the trial ends, the subscription begins and the first payment is taken.

Refund policy. Subscription fees are non-refundable once a billing period has started, except where required by applicable consumer protection law (including the Australian Consumer Law and EU/UK statutory consumer rights). If you believe you were charged in error, contact us within 14 days at hello@syncsocial.com.au and we will review your case.

Price changes. We may change subscription pricing with at least 30 days' advance notice by email. New pricing applies to your next renewal; you may cancel before that date to avoid the new price.

Failed payments. If a renewal payment fails, we will retry for up to 7 days and notify you in-app and by email. If payment cannot be collected, premium features will be suspended until billing is restored.

8. AI-Generated Content

The Service uses artificial intelligence to generate content suggestions. While we strive for accuracy and quality, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing, editing, and approving all content before publication. SyncSocial is not liable for any consequences resulting from the use of AI-generated content.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Where our liability may lawfully be limited, it is limited (at our option) to resupplying the Service or paying the cost of having the Service resupplied. Any limitation of liability in these Terms applies subject to those non-excludable rights.

10. Limitation of Liability

To the maximum extent permitted by law, SyncSocial shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless SyncSocial and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Northern Territory, Australia. You and SyncSocial submit to the non-exclusive jurisdiction of the courts of Northern Territory, Australia.
